Terms and Conditions (Terms of Use)
Welcome to StudentLAB (the “Service”). These Terms form a binding agreement between you and CanopyLAB, a company incorporated in Mexico ("StudentLAB", "we", "our", or "us"). By accessing or using the Service, you agree to these Terms.
If you are using the Service on behalf of a school or other organization, you represent that you have authority to bind that organization, and “you” includes that organization.
Eligibility & Accounts
Age & consent: You must be at least 13 to create a StudentLAB account. If you are under the age of digital consent in your country (typically 13–16), you may use StudentLAB only with verifiable consent from a parent/guardian. Where applicable (e.g., COPPA, GDPR‑K), we rely on schools or parents/guardians to provide consent for learners under the relevant age.
Under 13: Use is permitted only with verifiable parental/guardian consent or as part of a school‑managed implementation that has obtained required permissions.
Account security: You are responsible for safeguarding your credentials and for all activity under your account.
Accurate information: Provide accurate information and keep it updated.
Pricing, Certificates, Billing & Taxes
Core access to StudentLAB learning content and community is free.
Optional digital certificates recognize course completion and can be purchased on a per‑course basis or as a bundle.
Current prices (USD): Single Certificate — $5.99; Certificate Bundle (up to 3 courses) — $9.99. Prices are shown at checkout and may change; local taxes may apply.
Purchases are one‑time (not subscriptions). Receipts are provided at purchase; certificates are delivered to your account for download, under the “Courses” tab. You can only download a certificate once you have completed the course and all outstanding assignments have been approved.
Refunds: Because certificates are delivered digitally, purchases are generally non‑refundable, except where required by law or in case of billing error. Contact info@canopylab.com within 14 days if you believe there’s an error.
No academic credit or licensure: Certificates acknowledge completion of StudentLAB courses; they are not a degree, diploma, license, or professional certification.
Acceptable Use
You agree not to:
post or share unlawful, discriminatory, infringing, obscene, or harmful content;
harass, bully, or threaten others;
impersonate others or misrepresent your affiliation;
attempt to access non‑public features, interfere with the Service, or reverse engineer any part of it except as permitted by law;
upload malicious code, scrape, harvest, or mine data without our written consent;
use the Service to develop competing datasets or models where prohibited by separate terms.
We may remove content or suspend accounts that violate these Terms or applicable law.
Your Content & License to Us
You retain ownership of content you submit ("User Content"). To operate the Service, you grant us a worldwide, non‑exclusive, royalty‑free license to host, store, reproduce, modify (e.g., for formatting), display, and distribute your User Content solely to provide and improve the Service and as otherwise permitted by your settings.
If you submit feedback or suggestions, you grant us a perpetual, irrevocable, royalty‑free license to use them without obligation.
Intellectual Property & TeacherLAB Content
The Service, including software, templates, and branded materials, is protected by IP laws. We grant you a limited, non‑transferable license to access and use the Service for its intended purpose, subject to these Terms. No rights are granted except as stated.
Third‑Party Services & Links
The Service may integrate with third‑party tools (e.g., analytics, video, payment). Your use of those tools is governed by their terms and privacy policies. We are not responsible for third‑party services.
6A. Partners, Partner Content & No Endorsement
We collaborate with independent third‑party organizations and experts (our “Partners”) who create and publish courses and other materials on the Service (“Partner Content”). Partners are not employees, agents, or representatives of CanopyLAB, and their views are their own.
We do not endorse any Partner or Partner Content, and we do not guarantee its accuracy, completeness, or usefulness. Your reliance on Partner Content is at your own risk. Where content involves health, safety, legal, or other professional topics, it is provided for educational purposes only and is not professional advice or a substitute for professional care.
We are not obligated to screen all Partner Content, but we may review, edit (for format), demote, restrict, or remove any content and suspend or terminate any Partner’s access at our discretion, including for suspected policy violations, safety or legal risk (e.g., misinformation, intellectual‑property concerns, unsafe instructions), or reputational harm.
If you believe Partner Content violates law or these Terms, report it in‑product or email info@canopylab.com.
6B. Off‑Platform Interactions & Events
The Service may integrate with third‑party tools (e.g., analytics, video, payment). Your use of those tools is governed by their terms and privacy policies. We are not responsible for third‑party services.
Privacy
Our Privacy Policy explains how we collect and use personal data. By using the Service, you acknowledge our data practices described there.
Educational & Community Standards
We are an inclusive, learner‑first community. The following conduct is strictly prohibited in any shared space on StudentLAB (forums, comments, messages, projects):
Hate and dehumanization: zero tolerance for racism, anti‑Blackness, antisemitism, Islamophobia, xenophobia, casteism, anti‑LGBTQ+ content (including misgendering and slurs), misogyny (including “incel” ideology), ableism, or attacks on protected characteristics.
Genocide, mass violence, and suppression of rights: no content that denies, justifies, praises, or calls for genocide, ethnic cleansing, or mass violence, and no advocacy for suppressing the civil or human rights of any group (e.g., segregation, expulsion, disenfranchisement).
Privacy violations: do not share personal data, classroom recordings, images of minors, assessment results, or other sensitive information without proper consent; no doxxing.
Academic integrity & IP: no plagiarism; cite sources; upload only content you own or have rights to use; follow your school’s rules for assignments and assessments.
Safety and relevance: no spam, scams, malware, illegal content, or graphic/violent material.
Responsible AI: do not misrepresent AI‑generated content as your own where prohibited by course or institutional rules; do not use AI to harass, mislead, or cheat.
Enforcement. We may remove content, limit features, suspend or terminate accounts immediately for severe violations, and revoke improperly obtained certificates. Evasion (e.g., alternate accounts) is prohibited. Where we believe harm or unlawful activity is occurring, we may notify relevant institutions or authorities and preserve/disclose information as required by law and our Privacy Policy.
AI‑Assisted Features
Some features may use AI. You are responsible for reviewing outputs before relying on them. Do not input confidential or sensitive data unless you have the right to do so. Follow your instructor’s rules regarding AI in coursework.
Termination
You may stop using the Service at any time. We may suspend or terminate access if you materially breach these Terms or if required by law. On termination, your right to use the Service ends, but certain sections survive (IP, disclaimers, liability, arbitration/venue, etc.).
Warranties & Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non‑infringement. We do not warrant that the Service will be uninterrupted, secure, or error‑free.
Educational content only. Courses (including wellbeing and first‑aid topics) provide general educational information and are not medical, mental‑health, legal, or professional advice. They are not a substitute for professional care or emergency services. If you or someone else may be in danger, call your local emergency number immediately.
Limitation of Liability
To the maximum extent permitted by law, we (and our affiliates, officers, employees, and partners) will not be liable for: (a) indirect, incidental, special, consequential, or punitive damages; (b) loss of profits, revenues, data, or goodwill; or (c) aggregate liability exceeding the amounts you paid to us for the Service in the 12 months preceding the claim.
Indemnification
You agree to indemnify and hold us harmless from claims arising out of your misuse of the Service, your User Content, or your violation of these Terms or applicable law.
13A. Additional Indemnification for Publishers/Partners
If you publish content or act as a Partner, you agree to defend, indemnify, and hold harmless CanopyLAB and our affiliates, officers, employees, and partners from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your content, your use of the Service in a publisher/Partner capacity, or your violation of these Terms or applicable law.
Export Controls & Sanctions
You may not use the Service if you are subject to sanctions or in violation of export control laws. You agree to comply with applicable export and sanctions regulations.
Governing Law; Dispute Resolution
These Terms are governed by the laws of Mexico, excluding conflict‑of‑laws rules. Disputes will be resolved in the courts of Mexico City, unless local law mandates otherwise. If you prefer arbitration, replace this paragraph with your arbitration clause.
Changes to the Service or Terms
We may modify the Service and these Terms. If changes are material, we will provide notice (e.g., by email or in‑app). Updated terms become effective on the stated date. Continued use after that date constitutes acceptance.
